| 摘 要： | 囿于其不成文宪法传统与议会至上的宪法原则,几个世纪以来,英国司法审查一直局限于合法性审查的层面。但是,随着其宪法成文化趋势的加强,特别是20世纪后半叶以来,以欧共体法、欧盟宪法、人权法以及宪政改革法等为代表的"高级法"的相继出台,使得英国司法审查由合法性审查向合宪性审查转型成为可能。
