网络利益主体之间平衡实现的“幻景”——以“因特网条约”及其在美国、欧盟的实施为中心

网络技术的真正无国界使单个国家的著作权法无法协调网络技术给著作权所带来的冲击,"因特网条约"希望通过国际条约与国内法的共同努力使网络利益主体的平衡得以实现。但无论是"因特网条约",还是作为其实施法的DMCA与EUCD都较为明显地偏重著作权人的利益,尤其是技术保护措施的规定可能使代表公众利益的合理使用制度形同虚设,而网络技术发展也在著作权制度种种限制中如履薄冰,从而使网络利益主体之间平衡的实现无论在国际还国内都成为一种美好的"幻景"。

The "Illusion" of Realizing the Balance among Interests Parties on Internet——Centering on "the Internet Treaties" and Its Implementation in the US and EU

Under the condition of real no-national boundaries of internet technology, the sole national copyright law can not harmonize these conflicts brought by the internet technology. The ＂Internet Treaties ＂ hope that the balance among the subjects online can be realized by co-efforts of international law and inner law. Whether the ＂Internet Treaties＂, or its implementation law such as DMCA and EUCD have laid particular stress on the interests of copyright holder, especial the technical protection measures, making the systems of fair use not perform its function, moreover, the internet technology treads on eggs in many kinds of restricts of copyright. The balance among the Internet parties, whether international or national, be a beautiful ＂illusion＂.
