| 摘 要： | 由于刑事责任年龄与未成年人年龄界定之间的冲突，引起本罪与相关犯罪之间发生竞合。应当厘定本罪与相关间接正犯之间的界限。本罪的“组织”行为与教唆行为性质并不相同。本罪的范围不限于实施与财产有关的活动。同时，应当以宽严相济刑事政策为指导，认定本罪的着手和既遂。

| Abstract: | The conflict between the age of the criminal liability and the age of juveniles has caused the coincidence between the particular crime and other relevant crimes. So we should differentiate an indirect crime from this mentioned crime. The nature of this ＂organized＂ crime is different from that of abet crime. The range of this particular crime should not be confined to property crime. Then, we determine the act ＂to execute and complete the procedure according to the policy of justice with mercy and rules. |
