| 摘 要： | 从行政自由栽量权的一般理论着手，对包括行政自由裁量权的特点、分类及其失控问题和行政自由裁量权司法监督的方式、意义作了较为全面的探讨，提出了通过立法、执法、司法三个方面的合理运作，构筑我国对行政自由裁量权司法监督的综合网络。其中，通过对行政自由裁量权司法监督的若干构想，分层次、选不同的角度，针对理论和实践中存在的问题进行有侧重点的探讨。

| Abstract: | The present paper makes a quite comprehensive theoretical study about the features, classification and out of control of the judicial supervision of free administrative discretion and the way and significance of this issue. Through the reasonable operation of the three areas ： legislation, execution and judicial process to build up an integrated network of free administrative discretion＇s judicial supervision in China. Based on a number of ideas about judicial supervision of free administrative discretion, the present paper intends to discuss, at different levels and from different angles, on the problems theoretically and practically. |
