| 摘 要： | 交通肇事后肇事者逃逸现场的现象有增无减,给人们的生命、财产安全造成极大威胁。我国刑法典目前将逃逸行为依附于交通肇事罪,只作为交通肇事罪的一个情节,不利于对这种行为的抑制和打击。逃逸行为与肇事行为相比,有自己独立的罪质,具有严重的社会危害性,符合独立犯罪的本质特征,理应对其进行独立的刑法评价。我国刑法应借鉴其他国家和地区的做法,使逃逸行为脱离交通肇事罪,实现独立犯罪化。

| Abstract: | Now,many traffic accidents occur and the phenomenon of troublemaker's escaping from the scene of accident increases.In Chinese criminal code,escaping behavior attaches to the crime of traffic accident and it is a plot of the crime of traffic trouble.Compared with the behavior of traffic trouble,the escaping behavior has its own independent criminal nature.Therefore,there should be an independent criminal evaluation.We should draw a lesson from other countries: the escaping behavior departs from the crime of traffic trouble and it would be a independent crime. |
