| 摘 要： | 《联合国反腐败公约》本身和我国加入反腐败公约的政府决策,对腐败犯罪预防机制的贡献在于从法律规范的角度对这种机制的肯定。条件控制和成本控制是两种基本的腐败犯罪预防机制的作用机理。目前腐败犯罪预防机制的制度性机制则呈现出法律化、统一化、专门化和专业化的发展方向。就腐败犯罪预防机制的主要途径而言,各种腐败犯罪的预防机制大都以经济手段和政治手段作为基本的控制性手段,是实现腐败犯罪预防的条件控制和成本控制的主要方法。而腐败犯罪预防的刑事政策机制作为一种具有开放性的问题解决机制,也是建立完善的腐败预防机制的必需部分。

| Abstract: | The United Nations Convention Against Corruption itself and the approving Chinese official attitude toward it play a great affirmative role in criminal-preventing system in aspect of legal-norm.Conditions-control and cost-control are the two general functions of the corruption-preventing mechanisms.At present,the corruption-preventing institutional mechanisms are showing the legislative,unifying,institutionalizing and specializing directions.In aspect of the main approach to the corruption-preventing system,all corruption-preventing mechanisms are almost by economic and political means as the control means.It's the main approach to conditions-control and cost-control of the corruption-preventing system.Meanwhile,criminal-policy mechanism of corruption-preventing as an open mechanism to solve the problem is also an essential part to establish a sound corruption-preventing system. |
