商法强制性规范的发展大致经历了四个主要阶段.罗马万民法时期,私法中的强制性规范主要是民法规范而非商法规范.中世纪商法的强制性规范主要是针对商行为的构成性规范和教会法影响下的商业伦理道德规范.近现代商法中的强制性规范由于从"习惯法"到"制定法"的转型,而扩展到商主体法领域.当代商法的强制性规范因为"商法公法化"运动,形成了私法属性的强制性规范与公法属性的强制性规范共生的状态.
