交通肇事罪中两个"逃逸"含义的新解读

加重处罚肇事逃逸的目的是保护初次及后续事故中被害人的生命、健康权法益.除能证明不救助的行为与死亡结果之间存在因果关系外,肇事后不救助伤者以及不清除肇事形成的路障导致他人重伤、死亡或者使公私财产遭受重大损失的,均应认定为肇事逃逸.逃逸致死既包括不救助初次事故中的伤者致其死亡,也包括肇事者不清除路障引起后续事故致人死亡.成立肇事逃逸和逃逸致死不以逃逸前行为构成交通肇事罪为前提,肇事仅致一人伤害后不救助导致死亡的,应认定为逃逸致死;单纯逃逸的只需评价为逃逸致死,积极移置型逃逸升高了伤者死亡风险的,成立作为的故意杀人罪.
