| 摘 要： | 2013年5月1日正式实施的《中华人民共和国精神卫生法》,标志着我国精神障碍患者的合法权益将会得到根本性的保障,但该法对教唆精神障碍患者实施危害行为的法律责任界定却涉猎甚少.文章试图通过对相关法律法规的解读,基于我国已有的关于教唆行为法律责任的界定,试图明晰教唆精神障碍患者实施危害行为的法律责任,以便更好地保护精神障碍患者的权益和完善我国的法制建设.

| Abstract: | The mental health law of the PRC,which have been implemented On May 1,2013,protects the rights of patients with mental disorders. But the legal responsibility for instigating mental disorders to do harmful behavior is involved in a few. Through the interpretation of the relevant laws and regulations,and based on the existing definition of the legal responsibility for abetting the commission of crimes, the authors tried to clear the legal responsibility for instigating mental disorders to do harmful behavior,which could protect the rights of patients with mental disorders better and improve the construction of our country legal system. |
