因果关系不明情形的医疗损害责任认定

传统的“全有或全无”因果关系理论,在处理因果关系不明的医疗损害赔偿案件时,容易造成受害人求偿不能或侵权人赔偿过度的不良后果,影响侵权责任法填补损害功能的实现。文章起因于对一例医疗损害赔偿判决说理的质疑,通过梳理、论证比例责任适用于医疗损害侵权的可行性与类型,提出以比例责任作为因果关系不明情形的医疗损害责任的认定规则。

Identification of liability for medical damage under unclear causality

The traditional causality theory of“all or nothing”is inclined to cause such consequences that victims fail to claim or infringers over⁃compensate in cases of indemnity for medical damage while being used to handle cases concerned,which is against the purpose of the Tort Liability Law—to remedy damage.This study was originated from the doubt on the reasoning of a medical damage compensation judgment.By combing and demonstrating the feasibility and typification of proportional liability applicable to medical damage infringement,it put forward the determination rule of proportional liability as the medical damage liability in the case of unclear causal relationship.
