| 摘 要： | 医疗损害赔偿无过错责任，可能导致“选择性医疗”“防御性医疗”的大面积采用、医疗费用的普遍上涨以及医务人员注意义务下降等诸多问题。而现行的法律制度可以对患者权益给予比较周到的保护，故不应建立医疗损害赔偿无过错责任制度。

| Abstract: | The no-fault liability in the compensation for medical injury may cause various doctor＇s dominating treatments and defensive treatments and general rise of medical expenses as well as the decline of doctor＇s attention. So the author considered that the current system could provide considerable protection for the patients and the no-fault liability was noneffective in our legislation. |
