| 摘 要： | 为了遏制日趋严重的单位犯罪现象,修改后的刑法对单位犯罪作了较为客观的规定.由于法律对单位犯罪的概念未作明文规定,单位犯罪的立法过于膨胀且其刑罚存在诸多不协调之处,不仅影响单位犯罪的司法适用,还不利于刑法理论的发展,需要加以完善.

| Abstract: | Unit crime has been provided objectively in the revised criminal law in order to prevent the serious phenomenon of unit crime .The concept of unit crime has not been stipulated in the criminal law, as well as the defect of expanding legislation and nonharmonious punishment , which not only effect the judicial application of unit crime but the development of criminal law theory, and the perfecting legislation is wanted. |
