新时代法院在线调解平台建设现状及优化策略研究

近年来,社会外部环境的变化对司法提出了新挑战,而法院在线调解平台的建设完善了在线纠纷解决机制。法院在线调解平台在定位上更加明确,功能设置上趋于完善,但仍存在地区化与标准化、智能化与老龄化、司法引导与司法强制的现实冲突。针对当前法院调解平台在线调解资源共享程度不足、在线调解平台建设不够健全、在线调解人员专业水平不足的问题,文章提出培养多元解纷理念、完善调解平台统一化与解纷多元化、实现调解规则与信息技术有机结合、加强多元化解纷调解制度衔接、构建有效评价反馈机制。

Research on the Current Situation and Optimization Strategy of the Online Mediation Platform of Courts in the New Era

In recent years, the changes of the external social environment have posed new challenges to the judiciary. The construction of online mediation platform of the court has improved the online dispute resolution mechanism. The online mediation platform of courts is more clear in positioning and more perfect in function setting, but there are still realistic conflicts between regionalization and standardization, intelligence and aging, judicial guidance and judicial coercion. In view of the problems in the current court mediation platform that online mediation resources sharing degree is insufficient, the construction of online mediation platform is not perfect, online mediation personnel professional level is insufficient, the paper suggests it should cultivate the concept of diversified dispute resolution, improve the unification of mediation platforms and diversification of dispute resolution, realize the organic combination of mediation rules and information technology, strengthen the cohesion of diversified dispute resolution mediation systems, and establish an effective evaluation and feedback mechanism.
