| 摘 要： | 在自然属性、文化特征等方面，道地药材与地理标志有着许多的契合点，以地理标志制度对道地药材予以保护被认为是最为适宜的一种工具。但我国现行法律采用商标法与专门法结合的“混合保护模式”，容易产生权利冲突。理顺法律关系，协调主管部门的职能，明确质量标准，实施“国家地理标志战略”，以推动我国道地药材产业的发展。
