突发公共事件在我国是一个重要的社会问题,它有其本身的特点和表现形式,也有其发生的主要原因,完善我国突发公共事件应急法制建设主要有以下基本构想和具体建议:一、突发公共事件应急法律规范和应急预案的制定;二、依法设立突发公共事件应急管理机构并明确其职责划分;三、完善公共危机状态下的法律调整机制;四、完善突发公共事件的执行程序和权利救济机制;五、相关应急制度与法制体系的协调统一;六、应急法制体系建设的相关法律制度的改革和完善。

The Features and Causes of Public Incidents in China and Proposals about Relative Laws Making

Public incident is one of the important social issues in China.The causes and the ways of how the public incidents take place are specific.This paper aims to make proposals about perfecting the laws for public incidents as follows: 1.to draw up emergency preplans and special laws for public incidents;2.to establish the administrative institutes and clearly stipulate the responsibilities;3.to improve the adjustable mechanism under serious situations;4.to perfect social relief mechanism and the procedures of handling public incidents;5. to coordinate emergency handling systems with the stipulations of the laws;6.to reform the relative legal systems so as to handle public incidents effectively.
