论我国当前法律意识现代化的阻却因素

法制现代化最终是人的现代化,法治的最终实现也必将落实在社会大众法律意识。法律意识的普遍提高具体表现为社会大众权利意识的普遍觉醒。由于法律意识的提高深受社会结构、文化以及法律本身的价值的影响,所以必将存在着直接制约着公民法律意识的提高、影响法律制度的贯彻与实施阻却性因素。基于此,文章首先阐述了法律意识现代化的阻却因素的理论语境和现实背景,接着深入分析了我国当前法律意识现代化的阻却因素的现象及其原因,最后提出了消解这种具有异化性能因素的原则及策略。

Current Resistant Elements in the Law Awareness Modernization in our Country

The modernization of Chinese legal system should be the modernization of the people, and the success of the ruling by law depends on people' s law awareness. The widespread exaltation of the people's law awareness should be embodied in the form of the waking up of their right awareness. Because of the exaltation of the law awareness is deep influenced by the social structures, culture and the value of the law itself,there must exit the resistant elements, which directly limit the exaltation of the people's law awareness and influence the enforcement of the legal system. Thus, the article first begins with the analysis of the theoretical context and realistic background of the resistant elements, then analyzes the phenomenon and its causes, and finally it suggests some principles and strategies to remove the resistant elements.
