试论我国宪法保障体系的重构

一个完善而有效运作的宪法保障体系是宪法作为国家根本大法实现其最高法律效力地位的必然要求.针对我国现行的宪法保障制度中存在的诸多缺陷,文章提出应建立一个独立的宪法监督机构--宪法法院,并以此为核心改革和完善宪法解释、违宪审查制度,确立宪法诉讼制度,使我国的宪法监督体系得以重构.

Reconstruction of Chinese Constitutional Safeguard System

A sound and effective system of the constitutional safeguard is an inexorable demand for constitutional law, as the fundamental law of the state to fulfil its supreme legal authority. According to the defects existing in our current system of constitutional safeguard, this paper suggests the establishment of the constitutional court as a supervision organ, upon the core of which, the system of constitutional interpretation and constitutionality review shall be reformed and improved, along with the establisment of the systems of constitutional action and constitutional safeguard.
