| 摘 要： | 在现代社会 ,捐赠作为一种以公益事业和他人利益为目的的行为 ,随着社会的进步和经济的发展日益增多。对捐赠法律性质的认定将直接决定对捐赠问题的法律适用。笔者就实践中两种主要的捐赠行为予以了分析 ,并得出结论 :以不特定多数人为受益人的捐赠应被定性为一种单方法律行为 ,而为取得这种捐赠所进行的募集行为是一种委托代理行为。

| Abstract: | In modern society,donation,as benevolent acts for the interests of other people or the public,are increasing with the development of economics and progress of society.Which law should be applied to donation depends on its nature.This article analyzes the nature of donation and collection for donation,and concludes that the former should be regarded as a kind of unilateral legal act while the latter is the result of an appointment. |
