我国食品安全刑法规制体系的完善

近年来,食品安全事故频发,公众对食品安全的信任度下降,人人“谈食色变”,食品安全问题成为亟待解决的社会问题.我们确有必要反思我国当下的食品安全法律体系,为维护食品安全构筑严密的刑事法网.我国现行刑法对危害食品安全犯罪的规制存在刑事法网不严密,刑法定位不准确,刑法介入点滞后,罚金刑设置不科学等问题,一定程度上纵容了食品犯罪.我国有必要借鉴国外先进立法经验,转变立法理念,严密刑事法网,增设“持有不安全食品罪”、“拒不召回不安全食品罪”,将罚金刑由“无限额”改为“倍数罚金制”,同时注意与相关部门法的衔接,构建以食品安全法为核心的食品安全法律体系,以有效遏制食品犯罪,维护国民的食品安全.

Perfection on the Criminal Regulation of Chinese Food Safety

In recent years, food safety accidents often occurs, public confidence in food safety is falling, food safety issues become a social problem to be solved. We really necessary to reflect on our current system of food safety law, to build a rigorous criminal law for maintaining food safety . Chinese current criminal regulation on food safety exist problems, criminal law is not tight, the position is not accurate, criminal law point of intervention lag, legal punishment unscientific, and so on. China necessarily learn from foreign experience, change legislative idea, strict criminal law, add holding dangerous food crimes, non-recalling dangerous food crimes, the fine penalty from ＂unlimited＂ to ＂multiple penalty system＂, effectively curb food crimes and maintaining national food security.
