| 摘 要： | 环境行政是环境法治建设中最重要的手段.就中国现实而言,环境行政的相关基本制度难以落实,环境行政机构缺乏相应能力,环境行政处罚出现疲软效应,使得中国环境行政陷入困境.如果要突破困境,则应完善相关制度,同时对相关利益和责任进行合理分配.

| Abstract: | Environmental administration is one of the most important means of environmental protection in our country.However,in practice,relevant fundamental environmental administrative policies are not fully implemented,governmental environmental services lack the administrative capacity,and environmental administrative penalties are too soft to prevent the environmental damage.Therefore,only the rational allocation of relative interests and responsibilities could help to break through this predicament. |
