| 摘 要： | 我国现行刑法在环境资源的保护方面较以前有了很大的进步,但依然在环境资源的形法规制、范围和环境资源犯罪构成要件规定等诸多方面存在不足。当前,我们应当以科学发展观为指导,树立人类利益主义和自然利益主义相结合的刑事立法新理念,从环境资源的刑法规制体系、保护范围、环境资源犯罪构成的规定等方面进一步强化我国环境资源的刑法规制。

| Abstract: | The 1997 version of criminal law makes a rapid progress on the protection of environment and natural resources.However,it is defective in terms of its scientific system of legalization,the reasonableness of subjective ascertainment of liability,the improvement of objective ascertainment of liability,and the protection of scope.It is necessary to change the thought of legalization,to requisites constitute a crime,to enlarge the scope of protection. |
