论农村土地承包经营权的流转

农村土地承包经营权流转是土地问题解决中非常重要的一个环节,我国《农村土地承包法》和《物权法》对此都有相关规定。但是,由于立法的缺陷,造成实践中农村土地承包经营权的流转还存在许多问题,学界对此也产生很多争议。本文首先对我国农村土地承包经营权流转的立法历程进行了简要回顾,然后对我国农村土地承包经营权流转制度的缺陷进行了深刻剖析,最后提出完善土地承包经营权流转制度的建议。
