论我国刑罚适用模式的调整

刑罚适用模式是一个国家刑事法律制度文明进步的标尺之一。伴随着世界范围内犯罪非刑罚化和刑罚非监禁化的浪潮,西方发达国家实现了刑罚适用模式由监禁刑为主向非监禁刑为主的转换。而我国的刑罚适用模式仍以监禁刑为主体,非监禁刑在刑事立法和司法中长期受到冷落。为适应日益开放的社会、需要缓解我国监狱行刑困境,为追求科学的刑事政策和谦抑性的刑罚价值,调整我国传统的刑罚适用模式显得尤为必要;同时,社会结构的转型、罪犯构成和需求结构的变化以及国际社会的长期努力,又为这种调整提供了现实条件。

On the Adjustment of the Pattern of the Application of Penalty in China

The pattern of the application of penalty is one of marks of a country' criminal law system.With the trend of the Non-Penalization and Non-imprisonment in the world,the developed countries in the West have gradually reduced the application of custodial penalty,augmented the use of Non-custodial penalty and realized the transformation of penalty applicable model from custodial penalty to Non-custodial penalty.But custodial penalty still remains the principal sector of the penalty system in China,Non-custodial penalty walks with difficulty.It is necessary to adjust our country' pattern of the application of penalty in order to adapt to the opening society,ease the difficulties in execution of our jail,pursue the scientific criminal policy and the frugal penalty value.Meanwhile,the transformation of the structure of society,the change of criminals structure and great efforts of international societies prepare the ground for the adjustment of our pattern of the application of penalty.
