社会主义法制视角下的检察权设计

我国宪法明确规定检察机关是国家的法律监督机关,根据检察机关的宪法定位及社会主义国家检察权理论,我国检察权的主要任务在于保障社会主义法制的统一和正确实施。社会主义法制是由立法、执法、司法和守法四个环节构成的有机整体,但综观现行法律关于检察权的规定则主要集中在司法和个别执法环节,对于立法、守法和大部分的执法环节则缺乏监督权。检察机关的现有实际权力与检察机关的宪法定位之间的差距悬殊,使得检察机关的宪法定位显得＂名不符实＂。我国的检察权应对社会主义法制的上述四个环节均进行有效监督,进而实现检察机关的宪法定位＂名符其实＂。

Under Socialist Legal System Angle of Procuratorial Power Design

China＇s constitution stipulated explicitly that procuratorial organ is the national legal supervision institution,according to this constitution localization and socialist countries procuratorial power theory,our procuratorial power＇s primary mission lies in safeguard socialist legal system unified and correct implementation. Thee socialist legal system consist of four parts：legislation,law enforcement,judicature and law abiding,but the current law provisions about the procuratorial power mainly concentrates in judicature and individual law enforcement link,the legislation、law abiding and the majority law enforcement link lacks the supervisory authority. The great disparity between the procuratorial organs＇s existing factual power and its constitution localization,causes the procuratorial organ＇s constitution localization appears to ＂is unworthy of the name＂. So our country＇s procuratorial power need to carry effective supervision above this four links,in order to realize the procuratorial organ＇s constitution localization ＂to be worthy of the reputation＂.
