论国际环境法“共同责任”原则

学界对于国际环境法基本原则的认识上一直存有争议,目前尚不统一。在阐明国际环境法基本原则特点的基础上,从学理论证和文本实证的角度分析＂共同责任＂和＂共同但有区别责任＂,明确＂共同责任＂是国际环境法的基本原则,而＂共同但有区别责任＂仅是＂共同责任＂基本原则在国际气候变化应对领域中的具体运用。

On the "Common Responsibility" Principle of the International Environmental Law

Whether or not the ＂common responsibility＂ or the ＂common but differentiated responsibility＂ is the basic principle is not settled yet.Many Chinese scholars draw the conclusion on the wrong basis of inner environmental law.Based on the theory of international environmental law and the international environmental instruments,it is said that the ＂common responsibility＂ is the basic principle,for it reflects the spirits and is suitable in all scope of the international environmental law.The ＂common but differentiated responsibility＂ is only the application of the ＂common responsibility＂ principle in the international air pollution and climate change domain.Thus the ＂common but differentiated responsibility＂ can not evolved into a customary international law.Nevertheless it is of significance and ought to be insisted on by developing countries and is to grow into a concrete principle in the climate change sector,if used correctly.
