| 摘 要： | 上证信息与新华富时A50证券信息合同纠纷案，揭示了证券交易信息法律保护的重要性和紧迫性。明确证券交易信息权利的性质是法律保护的前提。证券交易信息权不同于传统的物权，是一种新型知识产权。针对我国目前交易信息领域法律规定分散、效力层次低的现状，应当借鉴发达国家信息保护的成功经验，立足于证券交易信息特点，在立法、司法等层面构建交易信息法律保护体系。

| Abstract: | ASO case, which Shanghai Stock Exchange Information- net Limited Company sued Xinhua FTSE Index Joint Venture Company , puts forward the importance and urgency of legal protection on securities trading information. Making clear the nature of securities trading information is the very premise to protect it. The right of securities trading information is different from traditional real right. It is a new kind of intellectual property rights. According to our legal condition in the information field, we should draw experience from developed country to build multi legal protection system on legislation and judicature. |
