刑事一体化视野下的恢复性司法

在我国,构建和谐社会是一项系统工程。刑事司法对于和谐社会的构建有着特殊的作用。在现代社会中,国家已经形成了强大的惩治犯罪的力量,但从国家应对犯罪的手段以及期待达到的目的看,都还是比较单一的。因此,在我国倡导恢复性司法,从犯罪发生和产生危害的自身规律着手,强调社会资源的整合和利用,形成超越性的刑事司法体制,有利于彰显我们和谐社会的本质。

The Integration of Criminal Justice and Restorative Justice

To construct a harmonious society is a systematic project, on the completion of which the criminal justice has a unique effect. In modern society, the state has a command of the strong power to punish the criminal offenders. But, as far as the means and the purposes of a country dealing with the crimes are concerned, they are really not varied. It is important for us to shift our attention to restorative justice. By studying how crime happens and what its patterns are, and emphasizing the integration and utility of social resources as well, we hereby form a new kind of criminal justice system, which will transcend the old one and help to show the meaning of harmonious society.
