| 摘 要： | 我国需要通过证据立法或者司法解释的方式,对鉴定结论的审查内容和认证标准加以规定,从而形成对法官有约束力的指导规则。采用分级分效的原则来制定指导规则:指导规则的适用范围逐级减小并且其强制效力逐级下降。最后讨论了一些主要的指导规则。

| Abstract: | Our country needs to form such guidelines through testimonial legislation or judicial interpretation to restrain judges that regulate the content of expert testimony and the standards for its adoption.Accordingly,the guidelines can be arranged by such different levels and effects: the narrower the applied scope of guideline is,the weaker its binding force.Moreover,some major guidelines are discussed at the end of paper. |
