| 摘 要： | 欲科学地制定一部法律,须首先酝思其立法构造.域外民事执行法的基本构造,大体有三种模式:完全混合式、完全并列式和总分结合式.这三种模式各有优缺点.目前我国正在酝酿制定单独的"民事执行法",因此很有必要从立法技术的角度探讨其立法构造问题.在这一过程中,域外民事执行立法的成功经验和我国的特殊国情,都应当作为考虑的重点因素.
