| 摘 要： | 中国法产生的具体途径及确切时间,以及使二者相对应是中国法起源研究的着力点.结合文献资料、传说和河南龙山文化的考古发现,认为中国法起源的途径是:由原始习惯到礼,然后经过对礼的筛选过渡到法;其时间相当于传说中的尧舜禹时代,在考古学上相当于河南龙山文化时期,也即公元前2400年左右.

| Abstract: | Focus has been put on the specific way and exact time of the emergence of China's Laws, and efforts have been made to make the two correspond with each other. Considering the relevant documents, legends and the archeological finds of the Henan Longshan culture, China's laws develop from primitive habits to courtesy, and then after filtration, to laws. The time corresponds with the period of Yao, Shun and Yu, which is known as the Henan Longshan Culture Period in 2,400 B.C. |
