| 摘 要： | 不真正不作为犯的关键问题之一是等价值性问题,只有具有等价值性,不真正不作为犯才能与作为犯同在一个犯罪构成要件中予以评价,犯罪才能成立。从存在论的角度看,不真正不作为犯与作为犯相比,是A与非A的关系,无法进行相当性比较,只有在其义务内容中去寻找,才能找到比较客观的标准,即应避免犯罪构成事实与作为犯所实现的犯罪构成事实相当。

| Abstract: | This article discusses equal value in offense of non-typical omission.Crime exists only if the offense of non-typical omission has the same value with omission which can be judged in the same constructive conditions.From the point of actuality,there can not be a comparison between the offense of non-typical omission and that of omission because of the relation between A and non-A.Equivalence only can be found in the duty of act,when the avoidable facts in the crime constructive conditions are equivalent to the facts realized by omission. |
