| 摘 要： | 汉朝伴随着儒家思想法律化进程的加快,司法官员常常通过引经决狱制作判例,规避法律,这种做法对两汉判例体系创建、司法官员自由裁量权的实现及儒家轻刑主张的具体实施意义重大,也为我们今天法官造法功能的实现提供了借鉴。

| Abstract: | With the argence need of the Confucianism theory permeate into law in XiHan Dynasty,The judge often used the confucianism moral principles decided the case and they often avoided the law.The action of creating law is very important to quicken the speed of Confucianism theory merge into law.In this way the precedent system had been founded in Han Dynasty.The action of Judge-made law made the Judge's authority of justice freedom into realize,the Confucianism theory of careful penalty had been effected.The action aslo afforded experience to us to exert our Judge-made law function too. |
