| 摘 要： | 《物权法》实施后，现行的《矿产资源法》已经不能适应矿业权市场的要求，应以《物权法》为基准，加快再次修法的步伐。应制定综合性的自然资源法，完善我国矿业权民事法律制度，规范矿业权市场中介服务行为，扩大探矿权采矿权流转渠道。

| Abstract: | In this paper,the present state and problems of mining rights transfer system in China are analysed.The paper also studies the way as to how to amend the "Mineral Resources Law" further after the promulgation and implementation of the "Property Law".The significant and practical suggestions of legal policy for the construction of the mining rights transfer system are propsed. |
