| 摘 要： | 我国的商业贿赂现象相当严重,已经成为某些行业、市场的"潜规则",它不仅破坏了公平竞争和正常的交易秩序,而且严重损害了消费者的合法权益.虽然禁止商业贿赂的法律条款早在1993年就写进了《反不正当竞争法》,但是整个社会对商业贿赂的认识仍然十分模糊,而现行的各种分散的规定,并未对商业贿赂行为作专门界定,且商业贿赂立法、执法方面都存在着不足之处.建议借鉴国外反商业贿赂的先进经验,完善我国对商业贿赂行为的法律规制,出台《反商业贿赂法》.

| Abstract: | The problem of commercial bribery problem is very serious in China.It has brought serious harm to economy and the whole society.Commercial bribery is not blank in China's legal system,but the legislation is scattered.Therefore it can not be applied to solve the serious and complex phenomenon of the present commercial bribery.With the country's attaching importance to the anti-commercial bribery,it is time to legislate an anti-commercial bribery law. |
