| 摘 要： | 我国的公益林生态效益补偿制度由天然林保护工程、退耕还林还草工程经济补偿规定、集体公益林生态效益补偿三部分构成。从国家的方针政策、森林法、民法、行政法等方面论述了公益林生态效益补偿的政策、法律依据 ,分析了现有公益生态效益补偿政策、法规实施现状 ,并结合具体国情探讨了我国公益林生态效益补偿政策法规设计的基本思路

| Abstract: | This paper probes into the legal basis and policy of ecological benefit compensation for public welfare forest from the aspect of CCP policies,Forest Law,Civil Law and Administration Law.The ecological benefit compensation system is composed of three parts:project of natural forest protection,economic compensation regulation in the project of returning cultivation field to forest or grassland,compensation for collectively owned public welfare forest.The current enforcement of policies and regulations is studied in detail.Finally,some suggestions concerning the design of policies and regulations of economical compensation for public welfare forest are put forward. |
