中韩行政革新的路径选择比较

行政革新是现代各国政治体制改革和制度变迁过程中的有机组成部分。近年来,中国和韩国都在持续地开展一系列的行政革新运行。然而,就路径选择而言,两国却截然不同。“立法推动”成为韩国行政革新的重要推进机制,中国行政革新的实践则主要是以政策推动的方式完成的,此类政策虽然能够取得近似行政组织法的地位,但却表现出某种程度的随意性和多变性的不利方面。借鉴韩国等国家的经验,中国未来的宏观改革有待实现从政策之治向法治之治的转变。

A Comparative Study on Path-choosing of Administrative Reform in China and Korea

Administrative reform is an integral component of the process of political reform and institutional change in modern countries.China and Korea both launched a series of administrative reform movements in recent years.However,two countries made completely different choices in path_choosing.Korea developed its administrative reform by means of enacting laws,which has contributed a fairly high legitimacy to its reform and indicated the feature and advantage of high stability.Different from Korea's path_choosing,China promoted administrative reform by means of making policies.Although they can achieve a status analogous to Administrative Organic Law,these kinds of policies are far from having enough seriousness and authority,as a result,there exist nature and disadvantages of random and uncertainty in the process of administrative reform in China.Through profiting from the experiences of Korea and other counties,China is to take action to accomplish the transformation from rule of policy to rule by law in near future' s macro_reform.
