司法的确定性应当是司法的一种应然状态,但司法活动是一个动态的过程,在司法实践中,由于案件事实认定、法律规则、法律解释、法律推理等不确定等因素的影响,司法结果往往是不确定的.要克服这种不确定性,确保司法结果的可预见性,就要完善立法,确立"法律真实"的案件事实观念,培养法官共同的职业道德和职业知识素养.

Uncertainty and Correction of Judicial Decision

The certainty of justice should be what it should be and judicial practice is a dynamic process. In judicial practice, the judicial result is often uncertain due to the influence of some uncertain elements like fact finding, the rule of law, legal interpretation, legal reasoning and so on. In order to overcome these uncertainties and ensure the predictability of the judiciary results, we should improve legislation and establish the concept of "legal reality" case facts, cultivate judges their common professional ethics and professional knowledge.
