农村房地产市场化的法律思考

摘    要:我国现行法律严格限制农村房地产市场化,农村房地产市场化举步维艰的一个关键障碍就是集体建设用地使用权不能自由流转。该权利的自由流转下农村房地产市场化是现实的客观需求,也具有法理基础。在法律制度上通过修改土地方面的法律、法规,为农村房地产市场化松绑势在必行。

Abstract:Marketing rural real estate is strictly controlled by our current legislation.The critical obstacle to marketing rural real estate is that the right of using the collective construction land is not allowed to circulate freely.Marketing rural real estate under free circulation of such a right is an objective need and is backed by legal systems.Therefore it is imperative to loosen the restrictions by modifying land laws and regulations.
