筚路蓝缕,以启山林：改革初期彭真的法律思想

＂文革＂之后到20世纪80年代,中国共产党的法律哲学集中体现在彭真的法律思想中。彭真从建国以来政治动荡的教训出发,坚持法律现实主义,提出了一系列民主法治思想：捍卫宪法和法律的权威、完善立法体制、保障司法独立等。彭真身体力行,积极推动法律创制,督促法律实施,推动了改革初期法律和社会的进步,为＂依法治国＂理念的提出奠定了基础。彭真对董必武法律思想有继承也有创新,代表了新时期共产党法律哲学的发展与变迁。

Peng Zhen＇s Legal Theory and Its Influence in China＇s Early Stage of Reform

As for the philosophy of law of the Chinese Communist Party from the end of the Culture Revolution（1976）to the1980s,Peng Zhen＇s legal thoughts are most representative.Taking lessons from the political turbulencs of New China and adhering to legal realism,Peng formulates a system of legal thoughts,such as upholding the authority of law and constitution,perfecting the legislative system,ensuring judicial independence,etc.And he himself practised the above principles to promote law-making and supervise law enforcement,which helped legal and social progress during the initial stage of reform and opening-up and laid a foundation for the＂rule of law＂in China.Peng both inherited and developed Dong Biwu＇s legal thoughts,reflecting changes and development of CCP＇s philosophy of law in the new era.
