论法治与德治的关系一从法律的内在道德谈起

法律在双重意义上与道德发生关系。法律的外在道德是指法律的实体目标,法律的内在道德则是指法律的解释和执行的方式问题,即一种特殊的、扩大意义上的程序问题。而法律的内在道德(或称法本身的价值)如强制性、明确性、普遍性、稳定性、官方行为与法律规则必须一致等主要原则对道德具有决定性影响。法律的这一特征启示我们在治国实践中,应明确法治相对于德治的前提地位。

On the Relation of Rule by Law and Rule by Virtue--Discussion from the Inner Morals of Law

The law establishes relationship with morals on the dual meaning. The outside morals of law refers to its entity, while the inner morals of law refer to the implementation of law, i.e. a special and extended procedural problem. But the inner morals of law, or the main principle of law such as the compulsiveness, clarity, universality, stability, governmental acts and legal regulations have decisive impact on morals. The above mentioned features reveal that rule by law should go before rule by virtue.
