| 摘 要： | 土地承包经营权在本质上是一种新型的用益物权,其变动方式包括土地承包经营权的消灭和土地承包经营权的流转。要解决当前农民利益受侵害的问题,不仅需要土地承包经营权物权化,而且需要依法行政等相关宏观法治环境的支持。

A Legal Perspective Study of the Right to Contractual Operation of Rural Land |

| Abstract: | The right to contractual operation of land, the basis for Man's living and development is new and peculiarly Chinese. How to specify its nature may influence the enthusiasm of farmers. The right to contract for management of rural land is essentially a beneficial right to things, the changes of which involve its elimination and transformation. Currently, we need not only make it one right to things but also execute it by law to prevent farmers' interests from being further offended. |
