| 摘 要： | 我国《合同法》并不排斥人格权合同,且实践中存在大量的肖像权、姓名权等人格权合同。人格权合同的正当性表现在主体和客体人格的区分、人格客体财产利益的出现、人格权支配权和处分权的产生三个方面。主体意义的人格与客体上的人格的区分是最为根本的前提条件。人格权合同法律规范应遵循过渡性和开放性原则、社会伦理原则、突破传统民法理论原则。
