嬗变时期的家族势力与村民自治

村民自治对于建构上层间接民主与基层直接民主、国家代议民主与社会直接参与的复合民主制的中国宪政制度具有重要的创新意义。然而,转型过渡时期的农村家族势力复兴并发展成为一股强大的力量,对村民自治制度的实施已构成严重的危害和威胁。应进一步完善基层直接民主选举制度,运用刑事法律打击妨害村民自治的行为,以确保村民自治制度得到正确实施。

Family Powers and Villagers' Autonomy

The villagers' autonomy is very important for the villagers to establish the indirect democracy of upper level and direct democracy of basic level,China's constitutional government system of the compound democracy of the state representative democracy and the social direct participation. At the transition of society,the rebirth and development of family powers of the countryside become a mighty force,which has caused some serious dangers and threats for the villagers' self-government system.Therefore,this paper makes a preliminary discussion on how to improve the democratic election system,to make use of criminal law to hit the behavior of interfering with the villagers' democracy so as to carry out the villagers' self-government system.
