| 摘 要： | 中国法制史研究者一般认为中国人厌诉是由于中国文化传统对民众价值取向的影响,但笔者更倾向于认为该情况取决于一个社会的诉讼制度以及整个社会能否为国民利用诉讼提供制度上的保证。本文试图从法经济学角度对这一现象进行分析,探讨藏族农牧民厌诉的实质原因。

| Abstract: | The scholars of Chinese legal history believe that the Chinese bore litigation owing to the influence of Chinese culture tradition for the public values.But the author thinks that such case depends on the social litigation system and whole society,from which he wonders whether the society can help the nations make good use of litigation with the assurance of the system.This paper tries its best to analyze this phenomenon from the point of view of legal economics so as to probe into true reasons of Tibetan farmers' bored litigation. |
