| 摘 要： | “检察机关”和“法律监督机关”作为宪法概念，内涵的界定应符合宪法文本的内在规范逻辑。以宪法文本中对“机关”的规范分析为出发点，通过融贯性解释，得出“检察机关”是从事检察业务和行使检察权的国家机关，只是作为检察院区别于其他国家组织的一种区别技术或符号代码，而“法律监督机关”则是对检察院组织性质的宪法定位。

| Abstract: | Defining “procuratorial organ”and“organ of legal supervision”should follow the intrin-sic logic of the constitutional texts ,as they are constitutional concepts .Starting from the standard analysis of “organ”in the constitutional texts and by coherence explanation ,this paper draws the conclusion that as a state organ for procuratorial work with procuratorial power ,“procuratorial organ” is a distinguishing technique or a symbolic code for procuratorate to differentiate from oth-er national organizations w hile“organ of legal supervision”is the constitutional positioning of the organizational nature of procuratorate . |
