中国知识产权国际保护的人权视野

自TRIPS协定生效以来,其确定了以动态贸易保护模式为主的知识产权国际保护体系。然而,TRIPS协定对知识产权人权性质的忽视严重影响甚至冲击了广大发展中国家的人权,为此国际人权组织进行了大量有益的努力和呼吁;但由于诸努力仍停留在知识产权私权保护的视野之下,故不足以真正建立公正、开放的知识产权国际保护秩序,惟有清楚地认识到知识产权是知识经济时代本共同体人权视野下的人权要求,才能构建出符合我国宪政实情的知识产权国际保护秩序。
