儿童监护权保护的国际立法及对中国的影响

为了对跨国婚姻破裂后的儿童监护权进行国际保护，国际社会已经形成多项全球性和区域性国际公约。这些公约都建立了缔约国之间的中央机关合作机制和司法与行政合作机制，以此实现儿童监护权的国际保护目标。中国应借鉴公约的规定，完善涉外监护制度的国内立法，同时考虑尽快加入相关的国际公约，以便更好地保护儿童的权益。

The Uniform Legislation to Protect International Child Custody and the Impact on China

In order to protect the international child custody after marriage-across-frontier is divorced, there are several global and regional conventions on the protection of international child custody. The mechanism of co-operation among central authorities of party states and the judicial and administrative co-operation which is established by these conventions have played an important role in the international protection of child. So as to better protect child's interest, we should refer to relative regulations of Conventions and get access to Hague Child Protection Conventions as soon as possible.
