《社会保险法》立法亮点与待解决问题探讨——以基本养老保险为例

2010年出台的《社会保险法》在基本养老保险方面更加注重保障参保人的权利,确立了覆盖城乡全体居民的基本养老保险制度法律框架,在参保范围及养老金领取制度方面都取得重大进展,但仍存在一些尚未解决的问题,如怎样实现社保基金的全国统筹、实现社保关系异地转移等。解决思路是尽快制定一系列配套的法律法规,并遵循城乡统筹、利益均衡原则,建立全国养老保险垂直管理体系,将"新农保"政策制度化等。

An Analysis of the Legislative Highlights and the Unsolved Problems of Social Security Law --Taking Basic Endowment Insurance as an Example

The promulgation of Social Security Law pays more attention to protect the rights of the insured in the basic pension insurance,establishes a legal framework for the basic pension insurance system covering urban and rural residents,and has made a significant progress in terms of the insurance scope and pension system.But at the same time,it exposes some imperfections,such as the ways to make national co-ordination of social security fund and to make the pension continuity to transfer in different places.The solution is to develop a series of supporting laws and regulations as soon as possible,and establish a vertical management system of the national pension insurance according to the principle of overall-planning the urban and rural areas and balancing their interests,so as to institutionalize the new rural social security policy.
