| 摘 要： | 通过对发达的市场经济国家反垄断法律制度的研究 ,揭示了卡特尔及可豁免卡特尔的一般构件 ,归纳出了可豁免卡特尔的主要类型 ,并以德国为例说明了豁免卡特尔的基本程序。还通过探究反垄断法中卡特尔豁免法律制度建立的根据 ,从我国实际出发并借鉴外国经验 ,提出了在制定我国反垄断法时 ,建立我国卡特尔豁免制度的几点建议

| Abstract: | This paper studies the law of anti-monopoly in developed countries, reveals the basic components of the cartel and exempted cartel, deduces the main types of cartel and displays the basic programs of exempted cartel by using examples from Germany. Based on the construction of cartel exemption system in the law of anti-monopoly and with reference to the experience of the foreign countries, it also raises some proposals of establishing our cartel exemption system when making the anti-monopoly law in China. |
