| 摘 要： | 实践表明,法治运行在我国民间社会表现出与既有的文化惯性、思维方式以及价值判断等方面存在着不适应,乃至冲突.立足于我国民间社会现实,正确认识国家法的角色、意义,以及民间社会内生秩序的合理自治,是避免法治不适的尴尬局面的客观选择.

| Abstract: | Practice has shown that the operation of rule of law is incompatible and even in conflict with existing cultural inertia,ways of thinking and value judgments in our civil society.To avoid the rule of law incompatibility,it is essential to understand in the light of the reality of our civil society the role and significance of state law as well as to recognize the appropriate self-governance of the spontaneous order in the civil society. |
